Terms & Conditions
1. Definitions and Interpretation
1.1 "justaddfood.co.uk " is the name of the internet retail site belonging to I.S. and A. Perry trading as The Cooks Shop, Riverside Place, Taunton, TA1 1JH. All mention of "justaddfood.co.uk" will mean The Cooks Shop, Riverside Place,Taunton.
1.2 "We" or "Us" means justaddfood.co.uk also known as The Cooks Shop, Riverside Place, Taunton
1.3 "You" shall mean a customer ordering goods from www.justaddfood.co.uk within the meaning of The Consumer protection (Distance Selling) Regulations 2000 and the Sale of Goods Act 1979 as amended.
1.4 "Goods" or "Products" shall mean those items to be supplied following an acknowledgement and acceptance of the order by us to you.
2. The Agreement
2.1 These terms and Conditions do not affect your statuary rights.
2.2 No changes by anyone but ourselves may be made to these terms and conditions
2.3 Where any error is made in the description of goods advertised on the justaddfood website we reserve the right to cancel any orders relating to that item without any liability on our part. We undertake to inform the customer of the error so that a new order can be made with the revised description. Clerical errors do occur from time to time and we will always amend quickly any misleading errors.
3. Orders & Delivery
3.1 The delivery and carriage terms are set out on the page entitled "Carriage & Returns"
3.2 Responsibility for the accuracy of the order lies with you the customer. It is advisable to give clear delivery instructions and post code.
3.3 Full payment with cleared funds is required when placing any order. We use Protx secure payments system for all payments by credit and debit cards.
3.4 An email acknowledging your order will be sent to within 24 hours of placing the order.
3.6 All goods on this are inclusive of vat except for books and food products which are zero rated.
3.7 All goods ordered are exclusive of delivery charge. These are laid out on the page entitled "Carriage & Returns" and on the shopping basket order form.
3.8 We use ParcelForce48 service and so allowing for order processing time and as all conditions previously stated are met, you should receive the goods within 3 - 5 days.
3.9 If we are out of stock of a product we will notify you immediately. We will also give an indication of how long we will be out of stock and you will be given the option of waiting for the stock to arrive in or cancel the order. We will communicate by email with any relevant information relating to the order.
3.10 If you have any problem with the product in terms of quality or damage please refer to the page entitled "Carriage & Returns".
4. Retention of Title
4.1 Any goods ordered shall belong to us until you have made full payment by cleared funds.
4.2 Title to the goods remains with us until physical delivery has taken place at the selected address supplied by you.
4.3 In circumstances of a dishonoured payment for any reason we reserve the right to recover by repossession the goods delivered or in transit.
5. Jurisdiction and Dispute Resolution
5.1 These Terms and Conditions are governed by the laws of England
5.2 If there is a dispute which cannot be resolved we will agree to Alternative Dispute Resolution in accordance with the Civil procedural Rules or procedures applicable from time to time.
6. Disclaimer
Justaddfood.co.uk has used all reasonable care to satisfy itself that the information contained within the website is accurate and based on current information. The information is as accurate as is reasonably possible and therefore none of the material (factual or otherwise) is to be treated as a statement or representation of fact.
Where hyperlinks exist to other websites Justaddfood.co.uk accepts no liability whatsoever for for the content of such third party sites.
Justaddfood.co.uk cannot control the use of information and materials on this site so Justaddfood.co.uk shall not be liable for any damage or loss whatsoever or howsoever caused,whether directly or indirectly arising from out or in connection, with the use of the information obtained.
7. Privacy Statement
As a matter of policy we will not use your name for any publicity purposes or provide to any third party information (other than in connection with law enforcement and only (if applicable) under court order) concerning you or your organisation without your express permission.
We will require personal information for making purchases which will include name, address, e mail address and postcode. A cookie may be required in connection with purchases which shall expire after completion of any purchase.
If we receive your voluntary details, we will not disclose them to any third party without your consent. We also value your security and take every precaution to protect your personal data.
8. Offensive weapons Act 1996
8.1 Under the Offensive Weapons Act it is an offence to sell any sharp and dangerous implements to persons under the age of 18. Any products on the Justaddfood.co.uk website that this applies to will have an 18 symbol clearly stated
8.2 By purchasing any item with the 18 symbol , you are declaring yourself to be 18 years of age and older.
9. Photography and Text
The photographic images and text used on this site may not be reproduced without written permission from I.S & A Perry, The Cook's Shop, Riverside Place,Taunton TA1 1JH. A charge will be made for this service.
